so many, many wrong!

Things I learned today from getting so many MBEs wrong:
  1. The federal govt is immune from paying state taxes, but this does not shwiel private parties from having to pay state taces, even if they're hired by the fed govt for fed projects.
  2. Already knew that a public figure needs to prove falsity and fault in a defamation case. But a public official or public employee who has or reasonably appears to have substnatial control over the conduct of public affairs must also prove this.
  3. I knew this damn rule: whenever it appears that a party to a sales K will not be able to perform, the other party can ask for assurance that it will perform. If the party then fails to respond to that request for assurance within a reasonable amt of time, the other party can take that as a repudiation.
  4. Threatening an airplane full of people while in the air with a supposed bomb is considered robbery! If you force them to transfer $ in exchange for not detonating the bomb, that's considered taking property by force from another person.
  5. Okay, for the last time: Evidence may be used to impeach AND may be admitted for substantive evidence if it relates to a material issue in the controversy. If the evidence is hearsay, then it must come in as an exception in order to be admitted as substantive evidence.
  6. Weird rule: The fact that a statute interferes with a person's fundamental right, alone, is not enough to make it unconstitutional.

Woe is me.
